Our current product and service portfolio covered under these Terms includes:

• Ksham Innovation Website (www.kshaminnovation.in)
• Able Assistant Mobile Application (“Able Assistant App”) — available on Google Play Store and Apple App Store
• All features, tools, and content accessible through the above platforms

Terms governing Able Glasses and associated hardware will be added as a separate addendum to this document upon product launch. Until then, these Terms apply exclusively to the App and Website.

4.1 Creating an Account

The Able Assistant App requires you to create a personal account and profile to access its full features. During registration, you will be asked to provide:

• Full Name
• Age and Gender
• Email Address and/or Mobile Number
• Password (which you are responsible for keeping confidential)
• Any other information required during onboarding

You agree to provide accurate, complete, and up-to-date information during registration and to maintain the accuracy of that information over time.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Not share your login credentials with any third party
• Notify us immediately at team@kshaminnovation.in if you suspect any unauthorised access to or use of your account
• Ensure you log out of your account at the end of each session, particularly on shared devices

Ksham Innovation shall not be liable for any loss or damage arising from your failure to comply with these account security obligations.

4.3 Account Deletion

You may delete your account at any time using either of the following methods:

• Self-serve deletion: From within the Able Assistant App via Account Settings
• Support-based deletion: By emailing a deletion request to team@kshaminnovation.in

Upon account deletion, your personal data will be handled in accordance with our Master Privacy Policy, including applicable data retention obligations.

5.1 Able Assistant App

• Taking the in-app audiometry hearing screening test and receiving your audiogram report
• Uploading an existing audiogram for reference or record-keeping within your profile
• Using the Able Assistant feature to ask hearing-related questions and receive informational responses
• Using the audiologist finder to locate RCI-certified audiologists near you and accessing their publicly listed contact information
• Contacting audiologists directly using the contact details displayed in the App
• Managing your personal hearing health profile and viewing historical audiogram records

5.2 Ksham Innovation Website

• Submitting enquiries through the Contact Us page
• Submitting a job or internship application via the Career page
• Reading blog articles and subscribing to our newsletter
• Reviewing audiologist profiles and information
• Learning about Ksham Innovation’s products, mission, and team via the About Us and Home pages

6.1 Misuse of Health Features

• Use, interpret, or present the audiometry screening test results as a substitute for a formal clinical diagnosis by a qualified healthcare professional
• Misuse, falsify, manipulate, or misrepresent the hearing test results or audiogram reports generated through the App
• Upload audiogram files belonging to another person without their explicit consent
• Use any health-related features of the App to self-diagnose, self-treat, or delay seeking professional medical attention

6.2 Impersonation and Misrepresentation

• Impersonate any RCI-certified audiologist, Ksham Innovation employee, or any other person or entity
• Submit false, fabricated, or fraudulent RCI credentials or professional information on the Audiologist Partnership page
• Claim affiliation with Ksham Innovation without our prior written consent
• Create multiple accounts or fake accounts for the purpose of misusing our services

6.3 Intellectual Property Violations

• Copy, reproduce, distribute, publish, download, scrape, or otherwise extract any content, data, code, or material from our App or Website without our prior written permission
• Use any automated tools, bots, scrapers, or crawlers to access or extract data from our platforms
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Able Assistant App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices on our content

6.4 Commercial Misuse

• Use our services for commercial resale, redistribution, or to build a competing product or service
• License, sell, transfer, or sublicense your access to our services to any third party
• Use data obtained from our platforms to build datasets, train machine learning models, or for any commercial research without our prior written consent

6.5 General Prohibited Conduct

• Use our services in any manner that violates applicable local, national, or international law or regulation
• Upload, post, or transmit any content that is defamatory, obscene, hateful, harmful, or in violation of any third-party rights
• Introduce any malware, viruses, trojans, or other malicious code to our platforms
• Interfere with or disrupt the integrity, performance, or security of our servers, networks, or services
• Harass, threaten, or harm other users, audiologists, or Ksham Innovation personnel through our platforms

7.1 Nature of the Test

The hearing screening test is:

• A self-administered screening tool for personal awareness purposes only
• Not a clinical audiological assessment and does not constitute a formal medical diagnosis
• Dependent on the quality of the device’s hardware (microphone, speakers, headphones) and the ambient noise level of the testing environment

7.2 Test Conditions

For optimal and reliable results, you are advised to:

• Conduct the test in a quiet environment with minimal background noise
• Use good quality over-ear or in-ear headphones rather than device speakers
• Follow all on-screen instructions carefully during the test

Ksham Innovation shall not be liable for inaccurate or misleading results arising from failure to comply with recommended test conditions, device hardware limitations, or user error.

7.3 Audiogram Upload

You may upload an existing audiogram report to your profile within the App. By uploading an audiogram, you confirm that:

• The audiogram belongs to you or you have the explicit consent of the person it belongs to
• You understand that the uploaded file will be stored on our servers in accordance with our Master Privacy Policy
• You will not upload audiograms for fraudulent, misleading, or illegal purposes

8.1 Informational Purpose Only

You expressly acknowledge and agree that:

• Able Assistant is designed solely to provide general informational content about hearing health and is NOT a substitute for professional medical advice, diagnosis, or treatment
• All responses generated by Able Assistant are for general awareness purposes and must not be relied upon as clinical guidance
• You should always seek the advice of a qualified RCI-certified audiologist or licensed medical professional for any hearing health concerns

8.2 LLM Limitations — Disclaimer of Liability

By using the Able Assistant feature, you acknowledge that you have read and understood these limitations and agree that Ksham Innovation shall bear no liability for any harm, loss, or consequence arising from your reliance on Able Assistant’s responses.

8.3 Conversation Data

Conversations between you and Able Assistant are processed in real time via our third-party LLM integration and are NOT stored or logged on Ksham Innovation’s servers. You are advised not to share sensitive personal identifiers (such as Aadhaar numbers, full address, or financial information) within the Able Assistant chat.

9.1 Nature of the Feature

• The audiologist profiles displayed in the App are based on information self-submitted by audiologists and verified by Ksham Innovation’s team for RCI registration status
• Ksham Innovation does not endorse, recommend, or guarantee the quality, availability, or conduct of any specific audiologist listed in the App
• The contact details provided are for the user’s convenience to independently initiate communication with an audiologist of their choice

9.2 Audiologist Responsibilities and Liabilities

Audiologists who register on the Ksham Innovation platform agree to the following:

• All information submitted — including name, photograph, RCI ID, contact details, and clinic address — is accurate, current, and truthful
• The audiologist holds a valid and current RCI registration at the time of submission and throughout the period their profile is active on the platform
• The audiologist shall promptly notify Ksham Innovation at team@kshaminnovation.in of any change to their RCI registration status, contact details, or professional information
• The audiologist is solely responsible for the quality of services they provide to users who contact them through or outside the platform
• The audiologist shall not use their listing on the Ksham Innovation platform to engage in any fraudulent, unethical, or unlawful professional conduct

Ksham Innovation reserves the right to remove any audiologist’s profile from the platform at any time, without notice, if it determines — in its sole discretion — that the audiologist has violated these Terms, provided false information, or engaged in conduct that is harmful to users or the platform’s integrity.

9.3 Disclaimer — User-Audiologist Interactions

Any communication, consultation, agreement, or transaction that takes place between a user and an audiologist — whether initiated through the App or independently — is strictly between the user and the audiologist. Ksham Innovation:

• Is not a party to any arrangement, agreement, or transaction between users and audiologists
• Does not monitor, record, supervise, or take responsibility for conversations, consultations, or advice exchanged between users and audiologists
• Shall not be liable for any outcome, harm, loss, or dissatisfaction arising from a user’s interaction with, or reliance on the services of, any audiologist listed on our platform

10.1 Contact Us

The Contact Us form is available for general enquiries, feedback, and support requests. We will endeavour to respond to all enquiries within a reasonable timeframe. Submission of the Contact Us form does not create any contractual obligation on Ksham Innovation to respond or take action.

10.2 Career Page

Job applications submitted via the Career page are subject to our recruitment process and Master Privacy Policy. Submission of an application does not guarantee an interview, offer of employment, or any contractual relationship with Ksham Innovation. We reserve the right to close, modify, or withdraw any vacancy at any time without notice.

10.3 Blog and Newsletter

Blog content published on our website is for general informational and awareness purposes only. Newsletter subscriptions are entirely voluntary. You may unsubscribe from our newsletter at any time by:

• Clicking the "Unsubscribe" link in any newsletter email
• Emailing a request to team@kshaminnovation.in

Unsubscription will take effect within 5 business days of your request. Please note that unsubscribing from the newsletter does not delete your account or personal data from our systems.

11.1 Trademarks

The name “Ksham Innovation,” “Able Assistant,” “Able Glasses,” and all associated logos, taglines, and trade dress are trademarks or registered trademarks of Ksham Innovation Private Limited. These marks may not be used in connection with any product, service, or communication without the prior written consent of Ksham Innovation.

11.2 User Content

Where our services allow you to upload or submit content (such as audiogram files or contact form messages), you retain ownership of your content. However, by submitting such content, you grant Ksham Innovation a non-exclusive, royalty-free, worldwide licence to use, store, process, and display your content solely for the purpose of delivering our services to you. You represent and warrant that any content you submit does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

12.1 Platform Terms

• Your download and use of the Able Assistant App through the Google Play Store or Apple App Store is also subject to the respective platform’s terms of service
• In the event of any conflict between these Terms and the platform’s terms of service, the platform’s terms shall apply solely in relation to your use of that platform; these Terms shall govern all aspects of your use of the Able Assistant App itself

12.2 Updates and Availability

• We may release updates, upgrades, or new versions of the App from time to time. We recommend keeping the App updated to ensure you have access to the latest features and security improvements
• Ksham Innovation does not guarantee that the App will be available on all devices, operating systems, or geographic regions
• We reserve the right to withdraw the App from any distribution platform at any time without prior notice

12.3 In-App Purchases and Paid Features

The Able Assistant App is currently available free of charge. We are committed to making core hearing health features accessible to all users at no cost. However, we reserve the right to introduce paid features, premium tiers, or in-app purchases in the future. When paid features are introduced:

• We will clearly communicate which features are paid and their applicable pricing
• Payments will be processed securely through the respective app store platform or other authorised payment gateway
• Refund policies for paid features will be governed by the applicable app store refund policy and will be communicated clearly at the point of purchase
• Free features currently available will not be made paid without prior notification to users

If you have any complaint, concern, or dispute relating to our services, your data, or our conduct, please contact our designated Grievance email:

16.2 Grievance Process

For privacy-related grievances specifically, please refer to our Master Privacy Policy for additional escalation options under the DPDPA 2023.

18.1 Termination by Ksham Innovation

Ksham Innovation reserves the right to suspend, restrict, or permanently terminate your access to any or all of our services, at our sole discretion, with or without prior notice, for any of the following reasons:

• Breach of any provision of these Terms
• Conduct that is harmful, fraudulent, or threatening to other users, audiologists, or Ksham Innovation personnel
• Submission of false, misleading, or fraudulent information
• Any activity that violates applicable law or regulation
• Any other reason that Ksham Innovation deems sufficient in its sole discretion

Upon termination, your licence to use our services shall immediately cease, and you must discontinue all use of the Able Assistant App and Website.

18.2 Effect of Termination

Termination of your account does not affect any rights or obligations that accrued prior to the date of termination. The following sections of these Terms shall survive termination: Sections 6 (Prohibited Conduct), 11 (Intellectual Property Rights), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Indemnification), 17 (Governing Law), and all other provisions that by their nature should survive termination.

22.1 Entire Agreement

These Terms, together with our Master Privacy Policy and any other policies or agreements incorporated by reference, constitute the entire agreement between you and Ksham Innovation regarding your use of our services and supersede all prior agreements, understandings, and communications between the parties on the same subject matter.

22.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by a duly authorised representative of Ksham Innovation.

22.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force and effect.

22.4 Assignment

You may not assign or transfer your rights or obligations under these Terms to any third party without the prior written consent of Ksham Innovation. Ksham Innovation may freely assign or transfer these Terms, in whole or in part, to any affiliate, successor, or acquirer without your consent.

22.5 Force Majeure

Ksham Innovation shall not be liable for any failure or delay in performance of its obligations under these Terms arising from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental actions, war, civil unrest, power failures, or failures of third-party infrastructure.

22.6 Language

These Terms are drafted in English. In the event of any translation, the English version shall prevail.
