Terms & Conditions for Audiologists

Welcome to Ksham Innovation Private Limited. These Terms & Conditions govern the onboarding, verification, and collaborative engagement of audiologists on the Able Assistant App.

By applying for verification or accessing services as a verified audiologist through the Able Assistant App, you accept and agree to be bound by the following terms and conditions. Please read them carefully.

Eligibility & Verification

  • Only licensed and qualified audiologists with degrees such as BASLP, MASLP, Au.D, or equivalent (recognized by RCI or relevant authority) may register.
  • Audiologists must submit credentials including qualification certificates, RCI license (if applicable), clinic details, and valid government-issued ID.
  • Verification is at the discretion of Ksham Innovation and may include background checks or credential validation.
  • Disclaimer: Ksham Innovation does not charge any fee or monetary amount from audiologists for verification or onboarding. If you receive any calls or messages requesting payment while claiming to be from Ksham Innovation, please report it to us immediately at team@kshaminnovation.in.

Purpose of Collaboration

By signing up, you agree to a collaborative partnership in which your role may include:

  • Providing clinical and professional guidance in developing Able Smart Aid Glasses.
  • Supporting the design and execution of prototype testing and validation studies.
  • Offering continuous feedback to improve product design and user experience.
  • Participating in or advising on initial clinical validation studies concerning the safety, usability, and efficacy of the device.

Preferred Sales Partner

As part of this collaboration:

  • You will receive preferential access to distribute and sell Able Glasses to your patients once the product is commercially launched.
  • This is intended to create additional revenue opportunities for your practice and foster a long-term, mutually beneficial relationship.

Non-Disclosure and Confidentiality

  • You agree to enter into a Non-Disclosure Agreement (NDA) with Ksham Innovation Private Limited to protect proprietary data, clinical information, and any unreleased product details.
  • You may not share, distribute, or disclose any confidential material or information received during this collaboration without prior written consent from Ksham Innovation.

Data Usage and Privacy

  • Personal and professional data collected during registration (e.g., name, credentials, clinic info, documents) will be used strictly for verification, collaboration, and platform communication.
  • You agree to allow anonymized user interaction data, clinical feedback, or consultation outcomes (non-PII) to be used for improving Ksham's services and research.

Intellectual Property

  • All rights related to the Able Glasses, the Able Assistant App, and any associated technology, branding, or content are owned by Ksham Innovation Pvt. Ltd.
  • Your participation does not imply any ownership rights in the product IP unless specifically agreed upon in a separate contract.

Platform Usage and Conduct

  • Audiologists must conduct themselves professionally while interacting with users and patients via the app.
  • Any promotional activity unrelated to Ksham Innovation or misleading representation is strictly prohibited.
  • Ksham Innovation reserves the right to suspend or revoke access in the event of misconduct, malpractice, or breach of these Terms.

Liability & Indemnification

You agree to indemnify and hold harmless Ksham Innovation Private Limited from any liability, claims, or damages arising out of:

  • Misuse of platform features or data;
  • Misrepresentation of qualifications;
  • Negligence or error in clinical guidance given via the platform;
  • Any disputes arising between you and the users you interact with.

Termination

  • You may opt out of the partnership at any time by writing to team@kshaminnovation.in.
  • Ksham Innovation reserves the right to remove or suspend any audiologist from the platform without notice if found in violation of terms or legal/ethical standards.

Amendments

Ksham Innovation may revise these terms periodically. Continued use of the app or platform after such changes implies your acceptance of the revised terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Nagpur, Maharashtra, and/or Mumbai, Maharashtra.
