To be eligible to apply, you must:

• Hold a recognised academic degree in audiology and/or speech-language pathology, including but not limited to: Bachelor of Audiology and Speech-Language Pathology (BASLP), Master of Audiology and Speech-Language Pathology (MASLP), Doctor of Audiology (Au.D), or an equivalent qualification recognised by the Rehabilitation Council of India (RCI) or a relevant statutory authority
• Hold a valid and current RCI Registration Certificate at the time of application and maintain it throughout the period your profile is active on the platform
• Be actively practising as an audiologist at a registered clinic, hospital, or healthcare facility in India
• Not be subject to any ongoing suspension, disqualification, or disciplinary proceedings by RCI or any other professional regulatory body

2.1 — Mandatory Documents

2.2 — Additional Information Required

• Full legal name (as per your RCI certificate and government ID)
• Professional email address and active contact number
• Clinic / practice name and complete address
• City and state of practice (for location-based search on the app)
• Years of experience and areas of specialisation (optional but recommended for a complete profile)

Ksham Innovation Reserves the Right To

• Accept or reject any application at its sole and absolute discretion
• Conduct additional background or credential checks if deemed necessary
• Request re-verification of your credentials at any time during the period your profile is active

5.1 — Platform Listing and Discoverability

• Your professional profile — including name, photograph, clinic name and address, RCI ID status, qualifications, and contact details — will be displayed to users of the Able Assistant App when they search for audiologists near them based on their location input
• Your profile will carry the “Verified” badge, distinguishing you as an RCI-verified audiologist on the platform

5.2 — Direct User Contact

• Users of the Able Assistant App may directly contact you using the contact number and/or email address listed on your profile
• Ksham Innovation does not facilitate, monitor, or intermediate communication between you and users. All direct contact is initiated solely by the user at their own discretion

5.3 — Access to User Audiogram Data (With Explicit User Consent Only)

In certain circumstances, a user may choose to share their audiogram results or hearing health data with you directly — for example, when consulting you for a follow-up appointment. You may only access, view, or use a user’s personal data or audiogram results when:

• The user has explicitly and voluntarily shared that data with you
• The sharing is for the purpose of providing professional audiological consultation or care to that specific user

5.4 — Priority Consideration for Commercial Collaboration (Able Glasses)

Verified audiologists listed on the Able Assistant App will be given first priority consideration for commercial collaboration opportunities related to Able Glasses, including:

• Becoming a preferred sales partner for distributing Able Glasses to patients once the product is commercially launched
• Participating in clinical validation studies, user research, or product feedback programs related to Able Glasses

6.1 — Accuracy and Currency of Information

• You shall ensure that all information displayed on your profile — including your RCI registration status, contact details, clinic address, and qualifications — is accurate and up to date at all times
• You shall notify Ksham Innovation promptly — and in any event within 7 calendar days — of any change to your RCI registration status (including renewal, suspension, or cancellation), contact details, clinic address, or any other material information on your profile, by writing to team@kshaminnovation.in
• Failure to maintain accurate and current profile information may result in suspension or removal of your listing

6.2 — Professional Conduct

• You shall at all times conduct yourself professionally, ethically, and in accordance with the standards and code of conduct prescribed by RCI and any other applicable professional regulatory bodies
• You shall not use your listing on the Able Assistant App to engage in any conduct that is misleading, deceptive, unethical, fraudulent, or harmful to users
• You shall not make any false or misleading claims about your qualifications, experience, services, or the efficacy of treatments to users who contact you through or as a result of the App
• You shall not engage in any form of unsolicited marketing, spam, or promotional communication directed at users who have contacted you via the App

6.3 — Prohibition on Unauthorised Promotion

• You shall not use your verified profile or the Ksham Innovation brand name, logo, or association to promote products, services, or practices unrelated to or not endorsed by Ksham Innovation
• You shall not represent yourself as an employee, agent, or official representative of Ksham Innovation. Your relationship with Ksham Innovation is that of an independently listed professional, not an employee or business partner (unless a separate commercial agreement is in place)

6.4 — Compliance with Law

• You shall comply with all applicable laws and regulations governing your professional practice in India, including the Rehabilitation Council of India Act, 1992, the Digital Personal Data Protection Act, 2023, and any other applicable healthcare, privacy, or professional conduct laws
• You shall not use the Able Assistant platform in any manner that violates applicable law

6.5 — Responsibility for Clinical Services

You are solely and entirely responsible for:

• The accuracy, appropriateness, and quality of any clinical advice, consultation, diagnosis, or treatment you provide to users who contact you through or as a result of the Able Assistant App
• Obtaining all necessary consents from patients as required by applicable law and professional ethics
• Maintaining adequate professional indemnity insurance as per RCI and applicable statutory requirements

Confidential Information includes, without limitation:

• Details of Ksham Innovation’s technology, products, algorithms, business strategy, and roadmap (including Able Glasses and Able Assistant)
• Any unreleased product features, clinical data, research findings, or user data you are exposed to
• Internal communications, proposals, or commercial terms shared with you by Ksham Innovation
• Any information that Ksham Innovation designates as confidential, or that a reasonable person in your position would understand to be confidential

You Agree That You Shall:

• Not disclose any Confidential Information to any third party without the prior written consent of Ksham Innovation
• Use Confidential Information solely for the purpose of your engagement with the Ksham Innovation platform
• Take all reasonable precautions to prevent the unauthorised disclosure or use of Confidential Information
• Promptly notify Ksham Innovation in writing at team@kshaminnovation.in if you become aware of any actual or suspected unauthorised disclosure of Confidential Information

8.1 — Your Personal and Professional Data

Personal and professional data collected during your registration and verification process — including your name, photograph, RCI ID, qualifications, government-issued ID, clinic details, and contact information — will be collected, stored, and processed by Ksham Innovation in accordance with our Master Privacy Policy, available at: www.kshaminnovation.in/privacy-policy.

Your data will be used for the following purposes:

• Verification of your professional credentials
• Display of your approved professional profile on the Able Assistant App for user discovery
• Communication with you regarding your listing, platform updates, and potential collaboration opportunities
• Compliance with applicable legal and regulatory obligations

8.2 — User Data — Your Obligations as a Data Handler

Where a user explicitly shares their personal data or audiogram results with you for the purpose of a consultation, you assume the role of an independent data controller for that user’s data. In this capacity, you agree to:

• Process the user’s data only for the specific purpose for which it was shared
• Not store, copy, share, or use the user’s data beyond the scope of the consultation for which it was provided
• Comply with the Digital Personal Data Protection Act, 2023 (DPDPA) and all other applicable data protection laws in your handling of user data
• Not disclose user data to any third party without the user’s explicit consent

8.3 — Anonymised Data for Research

You agree to allow Ksham Innovation to use anonymised, aggregated, and non-personally identifiable data derived from platform interactions — such as general consultation patterns or hearing health trends — for the purpose of improving Ksham Innovation’s services, products, and research. Such use will never involve any personally identifiable information about you or your patients.

You Specifically Agree That:

• You will not use the Ksham Innovation name, “Able Assistant,” “Able Glasses,” or any associated logos, trademarks, or branding without the prior written permission of Ksham Innovation
• Any clinical feedback, product suggestions, or testing outcomes you contribute during any collaboration shall, unless separately agreed, become the property of Ksham Innovation and may be used by us without further obligation to you
• You will not reverse engineer, replicate, or misappropriate any technology, feature, or content of the Able Assistant App or Able Glasses

10.1 — Grounds for Suspension or Removal

Ksham Innovation reserves the right to suspend, restrict, or permanently remove your Verification Badge and profile listing from the Able Assistant App in any of the following circumstances:

• Expiry, cancellation, suspension, or revocation of your RCI registration
• Submission of false, fraudulent, or misrepresenting credentials or information at any stage
• Breach of any provision of these Terms, including confidentiality, data protection, or professional conduct obligations
• Receipt of credible complaints from users regarding your conduct, clinical advice, or professional behaviour through or arising from the platform
• Any finding of professional misconduct, negligence, or disciplinary action by RCI or any other regulatory body
• Any legal proceedings, criminal charges, or convictions relating to your professional practice
• Failure to update your profile information within the required 7-day period following any material change
• Any other conduct that Ksham Innovation reasonably determines is harmful to users, the platform, or Ksham Innovation’s reputation

10.2 — Investigation Process

Where a complaint is received against a verified audiologist, Ksham Innovation will follow the process below:

10.3 — Effect of Removal

Upon suspension or removal of your listing:

• Your Verification Badge and profile will be deactivated and removed from the Able Assistant App
• Users will no longer be able to discover or contact you through the App
• Removal does not affect any legal rights or obligations that accrued prior to the date of removal
• The following provisions of these Terms will survive removal: Sections 7 (Confidentiality), 8 (Data Protection), 9 (Intellectual Property), 11 (Liability & Indemnification), and 13 (Governing Law)

11.1 — Ksham Innovation's Disclaimer

To the fullest extent permitted by applicable law, Ksham Innovation disclaims all liability in connection with:

• The clinical services, advice, diagnosis, or treatment you provide to any user, whether or not the user initially contacted you through the Able Assistant App
• Any dispute, claim, or complaint arising between you and a user, whether relating to clinical care, payment, professional conduct, or any other matter
• The accuracy or outcome of the verification process, which is based solely on the information and documents you submitted
• Any loss, reputational harm, or damages you suffer as a result of the suspension or removal of your listing, where such action was taken in good faith by Ksham Innovation
• Any technical failure, downtime, or unavailability of the Able Assistant App that affects your profile visibility

11.2 — Your Indemnification of Ksham Innovation

You agree to indemnify, defend, and hold harmless Ksham Innovation Private Limited and its directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, penalties, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Any breach of these Terms by you
• Any misrepresentation of your qualifications, credentials, or RCI registration status
• The clinical services, advice, or treatment you provide to any user or patient, including any claim of negligence, malpractice, or professional misconduct
• Any unauthorised use or disclosure of user personal data or audiogram results
• Any violation of applicable law by you in connection with your use of the Ksham Innovation platform
• Any dispute between you and a user arising from your professional services

12.1 — Voluntary Opt-Out by Audiologist

You may voluntarily withdraw from the Ksham Innovation platform and request removal of your listing at any time by submitting a written request to team@kshaminnovation.in. We will process your opt-out request within 7 business days. Voluntary withdrawal does not affect your confidentiality obligations under Section 7, which shall continue to apply indefinitely following withdrawal.

12.2 — Termination by Ksham Innovation

In addition to the grounds for suspension or removal set out in Section 10, Ksham Innovation may terminate your listing and access to the platform at its sole discretion, with or without notice, if it determines that continuation of your listing is not in the best interests of the platform, its users, or Ksham Innovation.

15.1 — Entire Agreement (Listing Arrangement)

For the purposes of the verification listing and Verification Badge on the Able Assistant App, these Terms — together with the Ksham Innovation Master Privacy Policy — constitute the entire agreement between you and Ksham Innovation and supersede all prior communications, representations, or agreements on the same subject matter. For commercial collaboration (Able Glasses, clinical studies), a separate MoU, LoI, and/or NDA will govern.

15.2 — Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, it shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall continue in full force and effect.

15.3 — Waiver

Ksham Innovation’s failure to enforce any provision of these Terms on one occasion shall not constitute a waiver of its right to enforce that provision on any future occasion.

15.4 — Relationship of Parties

Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between you and Ksham Innovation. You are an independently listed professional. Unless a separate commercial agreement is executed, you have no authority to bind Ksham Innovation to any obligation or commitment.

15.5 — Language

These Terms are drafted in English. In the event of any translation or interpretation dispute, the English version shall prevail.
